Article 1 β Definitions

Article 3 β Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated, before the distance contract is concluded, that the general terms and conditions can be inspected at the entrepreneur's premises and will be sent free of charge to the consumer upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions may be made available electronically in such a way that the consumer can easily store it on a durable medium. If this is not reasonably possible, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge by electronic means or otherwise at the consumer's request.
In the event that, in addition to these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs shall apply accordingly, and in the event of conflicting conditions, the consumer may always rely on the applicable provision that is most favorable to them.
If any provision in these general terms and conditions is wholly or partly void or annulled at any time, the agreement and the remaining provisions shall remain in effect and the relevant provision shall be replaced immediately by a provision that reflects the original as closely as possible.
Situations not covered by these general terms and conditions shall be assessed in the spirit of these terms and conditions.

Article 4 β The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer is subject to change. The entrepreneur has the right to modify and adjust the offer.
The offer includes a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these will be a truthful representation of the products and/or services offered. Apparent mistakes or errors in the offer do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot be grounds for any compensation or dissolution of the agreement.
Images of the products are a truthful representation of the products offered. However, the entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. This applies in particular to:
- The price, excluding customs clearance fees and import taxes. These additional costs are the responsibility and risk of the customer.
- Any shipping costs.
- The manner in which the agreement will be concluded and what steps are required for this.
Article 5 β The Agreement
The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions stated therein.
If the consumer has accepted the offer electronically, the entrepreneur shall immediately confirm receipt of the acceptance of the offer electronically.
If the agreement is concluded electronically, appropriate technical and organizational measures will be taken to secure the electronic transmission of data and ensure a secure web environment.
Juaryd may, within the legal framework, investigate whether the consumer can meet their payment obligations. If there are reasonable doubts, the entrepreneur reserves the right to refuse an order or attach special conditions to its execution.
Article 6 β Right of Withdrawal
When purchasing products, the consumer has the right to terminate the agreement within 30 days without stating any reasons. This withdrawal period starts the day after the consumer, or a representative, receives the product.
During the withdrawal period, the consumer must handle the product and its packaging with care. The consumer may only unpack or use the product to the extent necessary to determine if they wish to keep it. If the consumer wishes to exercise their right of withdrawal, they must return the product in its original condition and packaging, including all delivered accessories.
The return shipping is at the consumer's expense.
Article 7 β Cancellation Costs
If the consumer exercises their right of withdrawal, the costs of returning the products shall be borne by the consumer.
The entrepreneur will refund the amount paid as soon as possible, but no later than 14 days after receiving the returned goods.
Article 8 β Exclusion of the Right of Withdrawal
The entrepreneur may exclude the consumer's right of withdrawal for certain products as outlined in Article 8 of these terms and conditions, including personalized items or goods that cannot be returned.
Article 9 β The Price
The prices of the products or services will not be increased during the validity period stated in the offer, except for changes due to VAT or tax rates.
Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
All prices are subject to typographical errors, and no liability is accepted for the consequences of such errors.
Article 10 β Conformity and Warranty
The entrepreneur guarantees that the products comply with the agreement, specifications in the offer, and reasonable standards of reliability.
Defects or incorrect products must be reported in writing to the entrepreneur within 30 days of delivery.
The warranty period is in line with the manufacturerβs warranty period.
Article 11 β Delivery and Execution
The entrepreneur will deliver the products within the agreed period, no later than 30 days, unless otherwise agreed.
If the delivery is delayed, the consumer will be informed within 30 days of placing the order and may cancel the agreement with a refund.
Article 12 β Ongoing Contracts: Duration, Termination, and Renewal
The consumer has the right to terminate ongoing contracts at any time with due notice.
Article 13 β Payment
The consumer is required to pay the amounts owed within 7 working days from the start of the withdrawal period.
Article 14 β Complaints Procedure
Complaints must be submitted fully and clearly described within 7 days. The entrepreneur will respond within 30 days.
Article 15 β Disputes
Only Dutch law applies to contracts between the entrepreneur and the consumer.
